Rubbish Removal Battersea Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Battersea provides waste collection and rubbish removal services to customers. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

1.1 Company means Rubbish Removal Battersea, the provider of waste collection and rubbish removal services.

1.2 Customer means any individual, business, organisation, landlord, tenant or other party requesting or receiving services from the Company.

1.3 Services means all rubbish removal, waste collection, loading, transport, disposal, recycling and related services carried out by the Company for the Customer.

1.4 Premises means the property, site or location at which the Services are to be provided.

1.5 Waste means all items and materials agreed to be removed by the Company, excluding any prohibited or hazardous materials not accepted under these Terms and Conditions.

2. Scope of Services

2.1 The Company provides non-hazardous waste collection and rubbish removal services, including but not limited to household waste, bulky items, garden waste, light construction debris and general commercial rubbish, subject to applicable waste regulations.

2.2 The Company does not collect or transport certain categories of waste, including but not limited to asbestos, clinical or medical waste, chemical waste, gas bottles, explosives, biological waste, large quantities of liquids, or any other materials classified as hazardous or requiring specialist handling under applicable legislation.

2.3 The Customer is responsible for informing the Company of the nature and approximate volume of the Waste to be collected at the time of booking. The Company reserves the right to refuse collection of any waste that it reasonably believes to be unsafe, illegal, or outside the agreed scope of Services.

3. Booking Process

3.1 Bookings for rubbish removal in Battersea and surrounding areas can be made by telephone, email or other communication methods offered by the Company from time to time.

3.2 When making a booking, the Customer must provide accurate information including the Premises address, access details, parking information, approximate volume and type of Waste, and any particular requirements or constraints at the site.

3.3 Any quotation provided prior to arrival is based on the information supplied by the Customer and may be subject to change following on-site assessment of the Waste, access conditions, loading requirements or any other factors affecting the provision of Services.

3.4 Bookings are subject to availability. The Company will use reasonable efforts to attend the Premises on the agreed date and time window but does not guarantee specific arrival times. Time is not of the essence in relation to the performance of the Services.

3.5 The Customer, or an authorised representative over 18 years of age, must be present at the Premises at the time of collection unless agreed otherwise in writing. Where access arrangements are made for collection in the Customer's absence, the Customer accepts full responsibility for the accuracy of instructions and any consequences arising from those instructions.

4. Quotations and Pricing

4.1 Prices are typically based on the volume, weight and type of Waste, as well as labour time required, access conditions, and any additional services requested such as dismantling or extra loading.

4.2 Any initial quotation is an estimate only and is not binding until the Waste has been inspected by the Company's operatives on site. The Company reserves the right to revise the quotation if the Waste differs from the Customer's description or if the job is more complex than reasonably anticipated.

4.3 If the revised price is not acceptable to the Customer, they may refuse the Service before work commences, and no fee will be payable except for any agreed call-out charge. Once the Customer authorises the operatives to proceed with the work, the revised price is deemed accepted.

4.4 All prices are quoted in pounds sterling and may be inclusive or exclusive of VAT, as specified to the Customer at the time of booking or quotation, in accordance with applicable tax requirements.

5. Payments and Charges

5.1 Payment for the Services is due in full on completion of the work, unless otherwise agreed in writing. The Company may, at its discretion, require part or full payment in advance, particularly for large or commercial collections.

5.2 The Company accepts payment by cash, debit card, credit card or other methods notified to the Customer from time to time. For commercial Customers with approved credit accounts, payment terms will be set out in separate agreements or invoices.

5.3 If payment is not made on the due date, the Company reserves the right to charge interest on overdue amounts at the statutory rate allowable under applicable UK law, accruing on a daily basis until payment is received in full.

5.4 The Customer is responsible for all charges associated with the collection and disposal of the Waste, including any additional costs arising from inaccurate descriptions, difficult access, parking fees, fines or penalties incurred as a direct result of instructions given or withheld by the Customer.

6. Cancellations and Changes

6.1 The Customer may cancel or reschedule a booking by giving the Company as much notice as reasonably possible.

6.2 Where a cancellation is made more than 24 hours before the agreed arrival time window, no cancellation fee will usually be charged unless a non-refundable deposit was expressly agreed at the time of booking.

6.3 The Company reserves the right to charge a cancellation fee if the Customer cancels or reschedules within 24 hours of the agreed time, or fails to provide access to the Premises on arrival. Such fee will not exceed a reasonable proportion of the quoted price or a specified call-out charge to cover the Company's costs and lost opportunity.

6.4 The Company may cancel or reschedule a booking at any time if it is unable to perform the Services due to circumstances beyond its reasonable control, including but not limited to severe weather, traffic disruption, accidents, illness, vehicle breakdown, strike action or legal restrictions. In such cases, the Company will use reasonable efforts to notify the Customer as soon as possible and arrange an alternative appointment.

7. Access, Parking and Customer Obligations

7.1 The Customer must ensure safe and adequate access to the Premises for the Company's vehicles and operatives at the agreed time of collection. This includes arranging suitable parking and any necessary permits where required.

7.2 The Customer shall indemnify the Company against any parking charges, fines or penalties incurred as a result of following the Customer's instructions in relation to vehicle location or access.

7.3 The Customer is responsible for ensuring that the Waste to be removed is clearly identified and segregated, where necessary, and that it does not include prohibited or hazardous materials. If in doubt, the Customer must seek clarification from the Company before the collection date.

7.4 The Customer must take reasonable steps to ensure that the Premises and any access routes are safe and suitable for the Company's operatives to carry out the work. This includes removing obstacles where practicable and notifying the Company of any known risks, such as unstable structures, dangerous surfaces or aggressive animals on site.

8. Waste Regulations and Environmental Compliance

8.1 The Company operates in accordance with applicable UK waste management legislation and strives to handle Waste from Battersea and surrounding service areas in a lawful and environmentally responsible manner.

8.2 The Company will transport and dispose of Waste only at licensed facilities, recycling centres or waste transfer stations as appropriate. The Company may reuse, recycle or otherwise recover materials where feasible in order to minimise landfill and support sustainable waste management.

8.3 Title in the Waste transfers to the Company once it has been loaded onto the Company's vehicle, provided that the Waste is not prohibited or misdescribed. In cases where Waste is found to be illegal or hazardous without prior disclosure, the Company may return it to the Premises or require the Customer to make alternative lawful arrangements at their own cost.

8.4 The Customer warrants that all Waste presented for collection is their own property or that they have the right and authority to arrange its removal. The Customer shall indemnify the Company against any claims from third parties alleging unauthorised removal of goods or property.

9. Liability and Limitations

9.1 The Company will exercise reasonable care and skill in providing the Services. However, the Company shall not be liable for any loss or damage arising from inaccurate information given by the Customer, failure to disclose relevant matters, or the presence of prohibited or hazardous materials in the Waste.

9.2 While the Company's operatives will take reasonable care when removing items from the Premises, the Customer is responsible for protecting floors, walls, fixtures, fittings and other property that may be at risk of accidental damage during normal loading and removal operations.

9.3 The Company shall not be liable for minor cosmetic damage reasonably incidental to the performance of the Services, such as scuffs or marks that occur despite reasonable care being taken. Significant damage directly caused by the Company's negligence must be reported to the Company in writing within 48 hours of completion of the work.

9.4 To the fullest extent permitted by law, the Company's total liability to the Customer in respect of any claim arising out of or in connection with the Services shall be limited to the total amount paid or payable by the Customer for the specific job in question.

9.5 Nothing in these Terms and Conditions shall exclude or limit the Company's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be excluded or limited under UK law.

10. Customer Property and Non-Collection

10.1 The Customer must ensure that any items to be retained are clearly separated from the Waste to be collected. The Company accepts no liability for the removal of items mistakenly presented as Waste.

10.2 Where the Company reasonably believes that an item may have significant value or may not have been intended for removal, the operatives will, if practicable, seek clarification from the Customer before loading such item. However, the final responsibility for identification of Waste rests with the Customer.

10.3 If the Company is unable to complete the collection due to issues beyond its reasonable control such as restricted access, safety concerns, or the presence of prohibited materials, the Company may at its discretion charge a reasonable fee to cover time and costs incurred.

11. Complaints and Disputes

11.1 If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible so that the matter can be investigated and, where appropriate, remedied.

11.2 Complaints relating to damage, incomplete work or disputes over charges should be submitted in writing within a reasonable period, and in any event no later than 14 days after completion of the Services, providing as much detail as possible.

11.3 The Company will use reasonable efforts to resolve complaints promptly and fairly. Where a resolution cannot be reached directly, both parties agree to consider informal dispute resolution before resorting to court proceedings.

12. Data Protection and Privacy

12.1 The Company collects and processes personal data relating to Customers for the purposes of administering bookings, delivering Services, processing payments and handling enquiries or complaints.

12.2 The Company will handle personal information in accordance with applicable data protection laws in the United Kingdom and will take appropriate measures to safeguard such information against unauthorised access, loss or misuse.

12.3 The Customer is responsible for ensuring that any personal data provided to the Company, including contact details and access instructions, is accurate and up to date.

13. Changes to these Terms and Conditions

13.1 The Company reserves the right to amend or update these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated to Customers.

13.2 The Terms and Conditions applicable to a booking are those in force at the time the booking is confirmed. Continued use of the Company's Services following any updates shall constitute acceptance of the revised Terms and Conditions.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, their subject matter or formation.

15. General Provisions

15.1 If any provision of these Terms and Conditions is held by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable, and the remaining provisions shall continue in full force and effect.

15.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

15.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the prior written consent of the Company. The Company may assign or subcontract its rights and obligations where reasonably necessary for the efficient provision of the Services.

15.4 These Terms and Conditions constitute the entire agreement between the Customer and the Company in relation to the provision of rubbish removal and waste collection services and supersede any prior understandings, communications or representations, whether oral or written.
